Our Fiduciary Team have many years experience in this area and are able to help you devise the best plan for you in order to efficiently implement your intentions and dispel potential conflicts between the heirs when you are gone.

Trusts are probably the most versatile legal arrangement when it comes to estate planning. We have for many years assisted families in arranging their affairs through the use of Trusts to avoid the delays, publicity and costs associated with probate (or succession proceedings depending on which system of law applies to the estate of the deceased) when complex estates are passed on to subsequent generations. Trusts can quickly and efficiently pass the family property to the beneficiaries you name, without the hassles and expense of probate or succession proceedings.

Our Fiduciary Team have the experience and knowledge to provide a full range of fiduciary services including trusteeship, directorship, administration, registered office facilities, nominee services and executorship, through the use entities and legal arrangements such as trusts, foundations, companies and limited partnerships.

Applying our own expertise and that of other specialist advisers both within the HSBC group and our external network, we can offer our world wide clients informed and creative solutions for their tax, estate planning and structuring requirements.

The Fiduciary Team have access to two investment management models offered by other areas/members of the HSBC group, in order to help them perform their fiduciary duties with regards to financial assets under their control. Alternative arrangements with external service providers are also possible if the need for it benefits the clients.

• Investment Advisory

• Discretionary Management
  Our Fiduciaries have teamed up with the group's own asset management subsidiary company, HSBC Global Asset Management (Malta) Ltd to deliver to the trustees highly sophisticated investment strategies that are developed in accordance with the identified risk profiles of the individual trusts. These investment strategies are administered by the Manager on a discretionary basis in line with the following core principles:
  - Simplicity, transparency and liquidity
  - Capital preservation and risk management
  - Regular, proactive and effective reporting
  - Strict monitoring and review of performance targets

This service forms an integral part of the management process of our fiduciary responsibilities when the trustee/director is at the request of the client considering property investment in Malta, be it residential or commercial.

Our network of specialist real estate professionals are able to assist the Fiduciary Team in performing a deep analysis of property fundamentals, such as market value, location, quality of income and potential for long-term capital growth.

Occasionally it will make fiscal or commercial sense to incorporate entities within a trust or foundation. HSBC provides directorship services to such entities that are registered in Malta by appointing members from the Fiduciary Team to sit on the board of directors.

Our Fiduciary Team works with clients to formulate and implement a client's charitable strategy.

We provide a full range of philanthropy related services, including identifying suitable charities, carrying out due diligence and negotiate and structure grants in line with the objectives and goals of the charitable foundation or trust.
